Terms and Conditions

1. Preamble

The Client or Renter acknowledges having reviewed all the following conditions prior to making the reservation and further acknowledges having the capacity to enter into this contract.

The following general sales conditions govern all transactions conducted on the Desire Cars web catalog. Any order placed on this site implies the client’s unconditional and irrevocable acceptance of these conditions. If the Client or Renter does not agree with these Terms, they should refuse them and cease the reservation process. Otherwise, the Client or Renter acknowledges having read and understood these Terms and accepts them.

2. Conditions to Rent

You must provide us with the following documents at the time of vehicle delivery, with originals and proof:

  • A valid driving license for at least 24 months.
  • A passport.
  • A means of payment (Credit card, Cash, etc.)
  • We do not keep the originals of these documents.
  • All drivers must be at least 23 years old and hold a valid driving license for at least 24 months.

3. Duration of Rental/ Extension

3.1. Calculation Method

The rental duration is calculated in 24-hour periods, non-divisible, from the time of vehicle pickup. However, you benefit from a 3-hour tolerance after which a new 24-hour period is applied.

If you wish to extend your rental, you must obtain our prior approval. Once you have this approval, you must go to our agency to renew the contract and pay the additional rental amount.

If it is difficult for you to visit our agency, a copy of the extension contract will be sent to you by email or fax.

For all deliveries or returns outside Marrakech, the minimum rental duration must be equal to or greater than 7 days.

3.2. End of Rental

The rental is considered completed at the time of returning the keys and vehicle documents to our agent. If the vehicle is returned without its documents or keys, duplicate fees will be charged to the client. We cannot be held responsible for any items left in the vehicles after the rental.

4. The Vehicle

4.1. Vehicle Condition

You will receive a vehicle in working condition and clean. You must ensure that any apparent defects on the vehicle are noted on the rental contract before leaving the delivery location. Otherwise, any apparent damage not noted on the rental contract at the start of the rental will not be considered and will incur repair costs at your expense up to the deductible amount, except in cases where you have previously provided our claims service with a mutual report stating that you are not at fault. (See responsibility section in case of damage)

4.2. Vehicle Use

  • You agree to drive the vehicle “in a responsible manner”.
  • You agree to use the vehicle only on paved roads unless it is a 4x4. Any damage caused to the vehicle resulting from non-compliance with this clause will be the responsibility of the renter, and repair costs not covered by insurance will be charged to them.
  • It is prohibited to use the vehicle outside of Moroccan territory without written permission from us.

5. Payment

For any reservation made on our site, you will be asked to pay a deposit online, and the remainder will be settled upon delivery of the vehicle in cash or by credit card. However, except for deliveries at our agency, you must notify us by email or phone if you wish to pay by card so we can bring the payment terminal.

6. Insurance / Responsibility in Case of Damage

All our vehicles are insured against all risks, but a 10% deductible is the responsibility of the client in the case of partial or total liability.

We remind you that no insurance claim is possible if the renter does not present us with a mutual report or a police or gendarmerie report.

In case of loss/theft of the vehicle, accessories, or damage caused to it by the client, or in the absence of fault by a third party (accidental, during parking, collision with an animal crossing the road, cart, non-motorized vehicle, etc.), the client must report the incident specifying the causes and circumstances and compensate us up to the deductible amount.

7. Modification

Modifications at Desire Cars are free before the vehicle pickup.

7.1. Modification Before Vehicle Pickup

All modifications must be made via the client area or by email to contact@desirecars.com within 12 hours before vehicle pickup. Note: We reserve the right to accept or refuse this modification depending on the vehicle’s schedule.

If we accept the modification, a new voucher will be available in your client area. You must print it and present it on the day of delivery to our agent. If we refuse the modification, the initial reservation conditions and voucher remain valid.

7.2. Modification After Vehicle Pickup

If you wish to modify or extend your rental, you must obtain our prior approval. Once you have this approval, you must visit our agency to modify the contract and, in the case of an extension, settle the additional rental amount. If it is difficult for you to visit our agency, a copy of the extension contract will be sent to you by email or fax.

7.3. Early Return

After vehicle pickup and contract signing, any early return of the vehicle will not entitle you to a refund for unused rental days. However, you are entitled to a credit note equal to the number of remaining days.

8. Cancellation and No Show

You can cancel your reservation up to the last minute before the vehicle pickup time without a reason or justification.

The table below describes the cancellation fees applicable to your refund:

Cancellation more than 48 hours before vehicle pickup.

Cancellation less than 48 hours before vehicle pickup.

We will also cancel the reservation if the Client or Renter does not provide the required documents. In this case, no refund will be made.

In the event of a force majeure situation that prevents you from taking the vehicle, the deposit will be refunded upon presentation of proof (e.g., medical certificate, court order, etc.).

9. Client Obligations

  • It is the renter's responsibility to verify the vehicle’s condition and report any defects before using it. If a defect is not reported before use, it will be considered the renter’s responsibility.
  • The renter must ensure the vehicle is returned in the same condition as received, with all accessories and documents.
  • The renter is liable for any damage caused to the vehicle and for all expenses related to fines, penalties, and repair costs.

10. Personal Data Protection

Desire Cars collects personal data necessary for processing reservations. This data is stored securely and used solely for the purpose of fulfilling rental contracts and improving services. You have the right to access, modify, and delete your personal data by contacting us.

11. Dispute Resolution

Any disputes arising from the rental contract will be subject to Moroccan law. In case of disagreement, the competent court in Marrakech will have jurisdiction to resolve the dispute.

12. Changes to General Terms and Conditions

Desire Cars reserves the right to modify these general terms and conditions at any time. Any changes will be posted on the website, and it is the client’s responsibility to review them regularly. The modifications will be applied to all new reservations and will not affect the terms of previously made reservations.
